GENERAL PROVISIONS

  1. These Terms and Conditions ("Terms") set out the rules for using the DELTA MARINE STORE online store, operating at www.deltamarinestore.pl, including the rules for placing orders, entering into and terminating sales contracts, and the complaint procedure.

  3. Telephone contact is available on business days during the store's working hours, as stated on the website.

  4. The store conducts retail sales of goods via the Internet.

I. SCOPE OF ACTIVITY

  1. The DELTA MARINE STORE online store sells new, ex-display, and used products related to the marine and yacht equipment industry. Information about the condition of a given product is always included in its description.

  2. Product photos are for illustrative purposes only. Differences resulting from individual user screen settings do not constitute grounds for a complaint.

  3. All prices are given in Polish zloty (PLN) and include VAT.

  4. The Seller reserves the right to change prices, but such changes do not affect orders already placed.

II. TECHNICAL REQUIREMENTS

  1. Proper use of the store requires a device with Internet access and a web browser that accepts cookies.

  2. The Seller is not responsible for disruptions in the store's operation caused by technical factors on the user's side.

III. CONCLUSION OF CONTRACT AND ORDER FULFILLMENT

  1. Placing an order in the store constitutes acceptance of these Terms.

  2. The sales contract is concluded at the moment the Customer places the order and the Seller confirms it.

  3. Orders are processed in the order they are received, subject to product availability.

  4. The Seller reserves the right to refuse to fulfill an order if the Customer provides incorrect or incomplete data.

  5. The goods are delivered via the chosen carrier to the address indicated by the Customer.
    The Customer is obliged to check the shipment upon receipt in the presence of the delivery person.

  6. Order processing time and delivery costs are stated each time on the store's website.

  7. The Seller is not liable for delays caused by courier companies or events beyond its control.

IV. WITHDRAWAL FROM THE CONTRACT (RETURNS)

  1. A Consumer has the right to withdraw from a distance contract within 14 days of receiving the goods, without giving any reason.
    The right of withdrawal does not apply in cases specified in Article 38 of the Consumer Rights Act (including, among others, non-prefabricated goods prepared to individual order).

  2. To exercise the right of withdrawal, the Customer should send the Seller a withdrawal statement - to the email address: sklep@delta-marine.pl or by regular mail to the company's registered address.

  3. The Customer is obliged to return the goods no later than 14 days from the date of submitting the withdrawal statement.

  4. The returned goods should be complete and show no signs of use that would prevent resale.

  5. Goods cut to size or ordered specifically for the Customer are not eligible for return.

  6. The Seller will refund the Customer the equivalent of the purchase price of the goods.
    The costs of returning the goods are non-refundable.

  7. The refund is made within 14 days from the date of receiving the goods or proof of their return shipment.

  8. In the event of a return, the Seller may withhold the refund until the returned goods are received.

  9. The Customer is liable for any decrease in the value of the goods resulting from using them in a way that goes beyond what is necessary to establish their nature, characteristics, or functioning.

V. COMPLAINTS

  1. If physical defects or non-conformity of the goods with the contract are found, the Customer may file a complaint by email at sklep@delta-marine.pl or by post to the Seller's registered address.

  2. The complaint should include the Customer's details, a description of the defect, and the requested method of resolution.

  3. The Seller will process the complaint within 30 business days of its receipt.

  4. If the complaint is accepted, the Seller will repair the goods, replace them with new ones, or - if this is not possible - refund the equivalent of the price of the goods.

  5. If the complaint is not accepted, the Seller will inform the Customer of the reasons for the refusal.

  6. The item under complaint should be delivered at the Customer's expense, unless the complaint is accepted.

VI. PERSONAL DATA

  1. The data controller is DELTA-TEAM Sp. z o.o.
    Personal data is processed for purposes related to order fulfillment and in accordance with the store's Privacy Policy available at https://deltamarinestore.pl.

  2. The Customer has the right to access the content of their data and to correct or delete it.

VII. FINAL PROVISIONS

  1. These Terms are effective from the date of publication on the store's website and form an integral part of every sales contract concluded.

  2. The Seller reserves the right to amend the Terms.

  3. In matters not regulated by these Terms, the provisions of Polish law shall apply, including the Civil Code and the Consumer Rights Act.
    Any disputes arising in connection with the performance of the sales contract will be resolved by the competent common court in accordance with applicable law.
